Senior advocate Huzefa Ahmadi presented that the witness’s statement was not enough to file a case under the UAPA against Akhil.
A division bench of Guwahati High Court comprising justices Kalyan Roy Surana and Ajit Borthakur heard Gogoi’s bail plea. Senior Supreme Court advocate Ahmadi from Delhi represented Gogoi and argued for about three hours.
It may be mentioned that Advocate Ahmadi argued that the testimony of two key witnesses on the basis of which a chargesheet has been filed against Gogoi under the Criminal Activities Prevent Act is not enough. The senior advocate pointed out some information based on the statement of the two witnesses concealed by the investigating agency.
Solicitor General Tushar Mehta is likely to argue in the next hearing for the investigating agency NIA on November 19.
